5. Institutional & B2B Use
Hospitals, health systems, birth centers, and other institutional partners who license the DCM or related materials do so under a separate written Institutional License Agreement with Nana Approved, LLC. These Terms of Service govern general public use of the Site; institutional licensing terms supersede where applicable.
Institutions may not reproduce, redistribute, or sublicense any Nana Approved materials beyond the scope of their executed agreement without prior written authorization.
6. Indemnification
You agree to defend, indemnify, and hold harmless Nana Approved, LLC, its officers, affiliates, successors, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Site or breach of these Terms.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NANA APPROVED, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, ITS CONTENT, OR ITS PRODUCTS AND SERVICES — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE FROM WHICH THE CLAIM AROSE.
